ปชน.ชงรัฐบาลเอาผิด 'ฮุน เซน' ขึ้นศาลโลก ฐานอาชญากรสงคราม

เมื่อวันที่ 26 ก.ค. 2568 พรรคประชาชน (ปชน.) มีข้อเสนอต่อรัฐบาลไทยนำ ฮุน เซน ขึ้น ศาลอาญาระหว่างประเทศ ฐาน อาชญากรรมสงคราม จากสถานการณ์การปะทะที่ชายแดนไทย-กัมพูชา ที่เปิดฉากยิงโดยกองทัพกัมพูชา และมีการโจมตีไม่เลือกหน้าด้วยอาวุธยิงพิสัยไกลต่อเป้าหมายพลเรือน ทั้งโรงเรียน โรงพยาบาล ร้านสะดวกซื้อ บ้านเรือน จนทำให้พลเรือนไทยเสียชีวิตอย่างน้อย 16 ราย รวมถึงเด็กและผู้สูงอายุ และบาดเจ็บอีกอย่างน้อย 29 คน

โดย ฮุน เซน ประธานวุฒิสภากัมพูชา ยังได้โพสต์ในโซเชียลมีเดียส่วนตัว ยืนยันว่าตนเป็นผู้บัญชาการโจมตีอันส่งผลให้เกิดความเสียหายต่อชีวิตและทรัพย์สินของพลเรือนผู้บริสุทธิ์ชาวไทยด้วยตัวเอง

พรรคประชาชนเห็นว่าการกระทำดังกล่าวของฮุน เซน เข้าข่ายอาชญากรรมสงคราม การโจมตีพลเรือนโดยเจตนา ถือเป็นสิ่งต้องห้ามอย่างชัดแจ้งในกฎหมายระหว่างประเทศ ทั้งธรรมนูญกรุงโรมแห่งศาลอาญาระหว่างประเทศ มาตรา 8(2)(b)(i) และอนุสัญญาเจนีวา ตามมาตรา 147 ซึ่งนำไปสู่หลักเขตอำนาจศาลสากล (Universal Jurisdiction) ที่อนุญาตให้ทุกรัฐสามารถดำเนินคดีกับผู้กระทำผิดได้

พรรคประชาชนจึงขอเรียกร้องให้รัฐบาลไทย ดำเนินการยื่นฟ้องศาลอาญาระหว่างประเทศ เพื่อเอาผิด ฮุน เซน และ ฮุน มาเนต นายกรัฐมนตรีกัมพูชา ต่อศาลอาญาระหว่างประเทศ แม้ประเทศไทยจะยังไม่ได้ให้สัตยาบันธรรมนูญกรุงโรม แต่กัมพูชาเป็นรัฐภาคีของศาลอาญาระหว่างประเทศตั้งแต่ปี 2002 ศาลจึงมีเขตอำนาจเหนือคดีได้โดยตรง หากผู้กระทำความผิดเป็นบุคคลสัญชาติกัมพูชา

รัฐบาลไทยจึงมี 2 ทางเลือกที่สามารถดำเนินการฟ้องร้องได้ คือ

1. ยื่นเรื่องต่อสำนักงานอัยการศาลอาญาระหว่างประเทศ ตามมาตรา 15 เพื่อร้องขอให้เริ่มกระบวนการตรวจสอบเบื้องต้น (Preliminary Examination)

2. ประกาศยอมรับเขตอำนาจศาลเฉพาะกรณี ในฐานะรัฐเจ้าของดินแดนที่เกิดเหตุอาชญากรรมสงคราม ซึ่งวิธียี้จะเป็นการแสดงออกทางการเมืองที่เข้มแข็งชัดเจนต่อกัมพูชา ว่าไทยพร้อมปกป้องชีวิตและความปลอดภัยของพลเรือนผู้บริสุทธิ์ โดยใช้กลไกระหว่างประเทศ

พรรคประชาชนยืนยันว่าการดำเนินการฟ้องร้องต่อศาลอาญาระหว่างประเทศ ถือเป็นการใช้สิทธิ์ของรัฐผู้ถูกรุกราน ปกป้องสิทธิเสรีภาพของคนไทยโดยใช้กลไกระหว่างประเทศอย่างผู้มีอารยะ โดยหวังว่ากลไกดังกล่าวจะหยุดยั้งผู้นำกัมพูชาจากการโจมตีพลเรือนไทย และนำกัมพูชากลับสู่การเจรจาทวิภาคีเพื่อคืนความปกติสู่ความสัมพันธ์ของสองประเทศในอนาคต

Proposal from the People's Party to the Royal Thai Government on Referring Hun Sen to the International Criminal Court
In light of the recent border clashes between Thailand and Cambodia, which were initiated by the Cambodian armed forces, these events involved indiscriminate, long-range attacks on civilian targets within the Kingdom of Thailand, including schools, hospitals, a convenience store, and residential homes. These aggressions resulted in the deaths of at least 16 Thai civilians, among them children and the elderly, and left at least 29 others injured.
Furthermore, it has been widely reported that Hun Sen, in his capacity as the President of the Cambodian Senate, has publicly claimed, via his personal social media accounts, that he personally commanded these attacks, which led to the tragic loss of life and destruction of property belonging to innocent Thai civilians.
The People's Party posits that these actions constitute war crimes. The deliberate targeting of a civilian population is expressly prohibited under international law, specifically under Article 8(2)(b)(i) of the Rome Statute of the International Criminal Court and Article 147 of the Geneva Conventions. Such acts invoke the principle of Universal Jurisdiction, which permits any state to prosecute the perpetrators.
Therefore, the People's Party formally urges the Royal Thai Government to initiate proceedings at the International Criminal Court (ICC) to hold Hun Sen and Cambodian Prime Minister Hun Manet accountable for these alleged crimes.
While the Kingdom of Thailand has not ratified the Rome Statute, it is pertinent to note that Cambodia has been a State Party to the ICC since 2002. Consequently, the Court has direct jurisdiction over cases involving alleged crimes committed by Cambodian nationals.
The Royal Thai Government has two viable options to proceed with a referral:
1. Refer the situation to the Office of the Prosecutor of the ICC in accordance with Article 15 of the Rome Statute, requesting the commencement of a Preliminary Examination into the matter.
2. Make a declaration accepting the jurisdiction of the Court on an ad hoc basis for this specific situation, in its capacity as the state upon whose territory the alleged war crimes occurred. This course of action would serve as a firm and unequivocal political statement to Cambodia, demonstrating Thailand's unwavering commitment to protecting the lives and safety of its innocent civilians through established international mechanisms.
The People's Party affirms that pursuing accountability through the ICC is a legitimate exercise of the right of a sovereign state that has been subjected to aggression. It is a civilized and lawful approach to safeguarding the rights and security of the Thai people by utilizing the international legal framework. It is our hope that invoking these mechanisms will not only deter the Cambodian leadership from future attacks on Thai civilians but will also compel a return to bilateral negotiations, thereby restoring peaceful and normal relations between our two nations.
